Terms of Use

1. Purpose and acceptance

These Terms of Use (“ToU”) govern access to and use of the website and online services offered under the PhoxRay brand. By creating an account, logging in or using the platform, you unconditionally accept these ToU. If you do not accept them, you must not use the services.

2. Description of the services

PhoxRay is a web application aimed in particular at oral health professionals for processing dental radiograph images using artificial intelligence—including colorization, segmentation, mask editing, visualizations and image generations associated with the workflows offered.

The services are provided “as is”. PhoxRay may change features, models, usage limits or infrastructure (hosting, queues, third-party integrations) and may suspend or interrupt all or part of the services for maintenance, security or technical reasons, within reasonable bounds.

3. Nature of the outputs—professional use

Outputs produced by the AI tools are aids to visualization or image processing. They are not a medical diagnosis, clinical opinion or substitute for your professional judgment. You remain solely responsible for how you interpret and use images and results, in accordance with applicable regulations and professional duties (including professional secrecy and consent of data subjects when personal data, health data or content that could identify a patient is processed). Content you upload must also comply with Section 7 (prior anonymization or pseudonymization).

4. Access and eligibility

Access is reserved for oral health professionals acting in a strictly professional capacity and with legal capacity to contract. The services are offered B2B (business to business): they are not intended for the general public or for non-professional personal use. Some features require a user account and authentication (including mechanisms offered on the site, e.g. the Wix Members ecosystem depending on the configuration).

5. User account

You undertake to provide accurate, up-to-date information. You are responsible for keeping your credentials confidential and for all activity on your account. You must notify us without delay of any unauthorized use.

6. Subscriptions, credits and payment

Where paid plans, subscriptions or credit systems are offered, pricing, billing terms and specific conditions are shown on the site or associated subscription pages. Defaulting on payment or breaching subscription terms may result in suspension or termination of access to the relevant features.

7. Lawful use and user content

You must not use the services unlawfully, infringe third-party rights, upload malicious content, or circumvent security measures or usage limits. You warrant that you have the rights and permissions required for the images and data you submit.

Before any upload you undertake to submit only radiographs or other images that are anonymized or, failing that, pseudonymized, ensuring in particular that no patient identity appears on the image (name, date of birth, record number or any other identifying element visible on the image), insofar as such removal or substitution is reasonably practicable given the formats and uses.

Pseudonymization, where used, does not necessarily remove the personal nature of data within the meaning of the GDPR: you must still comply with applicable legal bases, professional secrecy and all rules that apply to you.

You remain solely responsible for the lawfulness of the content you submit, for prior anonymization or pseudonymization measures you implement where applicable, and for complying with your professional and regulatory obligations, including ethical rules.

Within the limits provided by law, you grant PhoxRay a technical execution license on the content you provide, strictly to deliver, host, process and display the requested services (including processing by technical subprocessors such as cloud hosts or AI inference engines as part of operating the platform).

8. Personal data

Processing of personal data is described in our Data processing policy, which supplements these ToU on confidentiality and rights of data subjects (GDPR).

Content that may contain health data is stored or processed through vendors or services for hosting and infrastructure whose offerings, within the applicable scope of these processing activities, may qualify as certified or qualified health data hosting (HDS) under French law where it applies to the relevant processing chain, in accordance with contracts and actual implementation. This wording is intended to inform you about hosting assurances provided by third parties and does not state that the PhoxRay service operator itself holds HDS certification as an entity separate from those vendors.

9. Intellectual property

All elements of the PhoxRay platform (interface, text, brands, logos, software, documentation) remain the property of PhoxRay or its licensors. Any unauthorized reproduction, representation or exploitation is prohibited.

Unless otherwise stated for a specific offer, rights to content you import remain yours; use of AI-generated results may depend on workflows and options shown in the application—if in doubt about a particular commercial use, contact us.

10. Limitation of liability

To the fullest extent permitted by applicable law, PhoxRay shall not be liable for indirect damages, loss of data, loss of business, inaccuracies or errors of AI models, temporary unavailability or incidents attributable to third parties (networks, hosts, authentication or payment providers).

If PhoxRay liability were established, it would, subject to mandatory rules, be limited to proven direct loss and, to the fullest extent permitted by law, shall not exceed the total amount you paid for the services in the twelve (12) months preceding the event giving rise to the damage.

11. Termination and suspension

PhoxRay may suspend or terminate your access in the event of a material breach of these ToU, abusive use or security risk. You may stop using the services at any time; obligations arising before termination (amounts due, liability for prior use) continue to apply.

12. Changes to the ToU

We may amend these ToU. The “Last updated” date at the top will be adjusted accordingly. Where required by law or where the change is material, notice may be given on the site or by e-mail. Continued use after publication constitutes acceptance of the updated ToU, subject to mandatory provisions.

13. Applicable law and disputes

These ToU are governed by French law. Failing amicable settlement, courts with jurisdiction under French law shall have competence, without prejudice to mandatory public-policy rules applicable to consumers.
